Default in your opinion is this murder?

ok, so a person has Aids or hiv and they know it. and yet they knowingly have unprotected sex with another person and that person doesn't know that their sexual partner is infected do you consider this to be murder? in my opinion it is murder, because the disease kills you, and there is no cure for it. if you knowingly infect someone then i think it is murder. just not by conventional means, its a long slow death. what is your opinion on this? do you think that an hiv or aids positive person who knowingly has unprotected sex with multiple partners without informing them of the disease should go to jail for knowingly infecting their sexual partners? i think they should be treated the same as any other cold blooded murderer.

Not necessarily. The virus isn't always a death sentence in this age of advance medicine. Attempted murder? Maybe. Assault with intent to harm? Definitely.

Actually there have been cases like this where the person was tried and convicted. I'm not sure of the exact charge though.....

I think it should be considered attempted murder. In the long run, it is going to kill the person if they are infected.

I consider it worse than murder. Because when you are murdered you die, but when you have AIDS, it is a long slow death.

On another note, I think science has come a long way that people with HIV tend to not get full blown AIDS until much later. But, I don't know all the facts...

Regardless of what the person would be charged with, I do think it should be considered a crime.

I guess I am in the minority here. I don't think a person who is infected with HIV or AIDs (two different things, I might add) who has unprotected sex without disclosing their medical history is guilty of alot of things: poor judgement, very loose morals, no social conscience, etc....but I don't think they should be accused of murder.

First, even if contract HIV there is no way of knowing if it will become full blown AIDS and kill you. With all the new medical knowlege and break throughs, so many people are living with HIV and living full, happy lives.

Second, why in the world, in this day and age, would anyone have unprotected sex?!? There are a lot more diseases you can get from unprotected sex than just AIDS or HIV. I think it is your own responsibility to keep your own body safe.

just my .02 though.

RileysMom117 - while I agree with some of your points I think that if someone intentionally has sex with someone to spread the HIV virus then they should be charged with something - not necessarily murder. I do agree that people SHOULD practice safe sex but then again if someone is intentionally trying to pass on the virus they *could* make sure a condom fails too.

I also agree with Liamsmyangel that HIV is worth than death in some ways. Dh's youngest brother found out he has HIV last year and it has devestated the family. He's young, 25 and is looking at a future of probably not being able to have children, for fear of passing it onto his future wife. He also can't afford all the wonderful medication he can take to keep him healthy, his insurance doesn't cover it-worried- . Yes, he was engaging in risky behavior but it is sad that 4 young people will live with this for the rest of their lives (bil's partner, her old partner, her old partners old partner).

I would say attempted murder...AT LEAST. Knowing what you have and not informing your partner is wrong.

I don't think it's MURDER because with the advanced medical technology and medicine it isn't a death sentence. Would it feel like it? Heck yes. But is the person guilty of murder? No, I think they are guilty of a malacious crime especially if their intent was to infect the person they were having sex with. Attempted murder, perhaps. Poor lack of judgement DEFINITELY.
There's so many stories going around where people were saying that there's a guy at Mardi Gras who pokes you with a syringe of "dirty blood", that holds the AIDS virus, thankfully that was a hoax. If a person were to inject you with a syringe of tainted blood then I definitely feel that's attempted murder and should be punished severly.
