If it's a bill that belonged to her husband before she married him, she's not liable. Even the IRS recognizes that by allowing the spouse of someone who owes back taxes to file an injured spouse claim. And why are they just NOW, eleven years later, contacting him about a gym membership? THAT is MY question....

I was gonna ask that same question. IMO, if you aren't even using the gym membership anymore, WTH?? How can they continually charge you for something like that?? Did he sign a contract to agree to a certain length of time or whatever?? How can they just contnue to charge you for that long and never contact you for payment till now?

I will happily work with anyone who is respectful to me but my question on this is didn't the contract have an early termination fee? If so shouldn't that be all you have to pay? Also, after 11 years wouldn't they just write it off as bad debt and take the tax break? It should have fallen of the credit report by now so don't admit to owing it just in case they are trying to get an agreement do they can reinstate it on your credit. I really think a termination fee would be possible collection but they may be trying to trick you into paying a trumped up charge or just some chick trying to steal your identity and that's why she wants a social. I'd make them send me proof as in a signed contract or something "your attorney" can look over b/c after this length of time who knows who this chick is trying to get personal info calling from a cell phone? Did she just find old Baileys' records and decide to try to bamboozle people for personal information? I'd repeatedly say "I really am questioning the legality of this entier situation" on the phone and insist that "I need to seek counsel before accepting this as a valid debt!"

This is my problem, too. When we moved here, five years ago, we got assigned a phone number. Well, this guy named Jason had it before who, apparently, was behind in EVERYTHING! So, we still get calls and the collectors ask me STUPID questions like "Are you sure you don't know him?" "Do you know how I can get in touch with him?" etc. AFTER I tell them that that was the previous phone number holder's name. They act like I am lying and there is no way I can find out where he is!! (Actually, by a strange twist of fate, I found out a couple of years ago that he lived next door to a friend of mine and moved out in the middle of the night. He was renting the place. We were just talking about silly phone calls and this came up.)

I have a very common name and a cousin with the exact name as my first name and maiden name so I also get calls that are not for me. I always feel like they don't believe me and it ticks me off. It's like 50 questions to get them off the phone.

any gym contract i have ever seen was for 1 year at a time. all they should be able to charge for is that year, not the 10 years after that. i could see interest gathering on the 100 or whatever the amount was at the end of the year, but come on, it couldn't have been that much interest.it would be something i would definately look into. it could pop up on future credit checks and ruin your chances of getting a loan or soemthing else.

i think the gym just hopes that some poor fool will be scared of collectors and pay just to get them off of their back. maybe they hope that someone won't know their rights?
it sucks either way!

This happened to me too, someone named Amy had our number and for some reason no one believed we weren't her (including the pizza guy and proex) But she jad a collector calling everyday, they were never rude, but I kept telling them she didn't have this phone number and to please quit calling and they would call the next day. Finally I asked to talk to a supervisor and he was nice and they quit calling,
