Default speaking of credit problems???

Ok so I am reading of all your credit issues and maybe someone cna help with mine!!!
My DH gets into an accident in nov, 2001. it took place in NH and we were uninsured, which is not against the law! He did damage and was his fault. Fine call us and we will pay! Well she tried to sue us for $25,000 but the state laughed in her face! So nothing else. Fast forward to Noveber 2002 and we get a small claims letter in Nc where we have finally moved to. Well instead of flying to NH and fighting we just pay the $1300.00. Not a problem until we go to buy a house and She never told the court that we paid Her like She is supposed to and we are screwed cause there is a claim on our credit report! What the crap?? It looks worse than a bankruptcy!!!!!!!!!!!!!
So we cannot get our final loan and our life is not looking so great! The only way to get it removed is to get Her to go down to the courthosue and tell them we paid Her! Even though I have all my receipts and stuff. What are we supposed to do and why can one little punk woman screw up our lives like this????????? Not fair! So I am hoping to find a way to fix this quick but no luck! Th court says there is nothing we can do to fight it. I am gonna try to sue Her I think, but in all reality they need to change the laws!!!!!! GRRRRRRRRRRRRRR!!!

Any ideas??? Anyone have to deal with this before?????? Thanks!!!

We dealt with something similar, but we live in Kansas. What happened was...when dh's divorce from his 1st wife was settled he was ordered to pay part of her legal fees. He paid her lawyers & they should have reported it to the courts. They didn't. Of course dh didn't know it & when we went to run a credit check for our mortgage loan it showed up. We called the courts & they told us there was nothing they could do. When we tried to contact her lawyers we found out that the firm had split & no longer existed! We ended up faxing all of our receipts & canceled checks to the actual credit reporting agencies (we had to send the info to all 3) & they did whatever verifying they do (who knows??) & it eventually was taken off. The bad news is it took them almost 2 weeks to get it off there. HTH

I applied for a home loan after my divorce. my credit check came back good except for two loans that my ex was responsible for - per the courts.
I explained this to the mortgage people and I think that I had to provide the divorce degree indicating this and I also wrote a letter indicating the above and had it notorized. I was approved for the loan, but his poor (and I mean poor) credit history is still on mine. The bank called me last spring on his loan and I explained the situation to them, told them I empathized with them (I lived with me haha), and told them how to better get ahold of him. I even asked why they didn't repocess the house as it was paid for to satisfy the debt. They have never called me since.

Have you tried calling her or writing her and asking her to help you out (in a nice way obviously)? I don't know that suing her will be all that helpful and it will be expensive. It can't hurt to ask.

I have no answers for anyone - sounds like you've been treated terribly. I do want to remind everyone though to get a copy of your credit report FREE at least once a year. Go to http://www.annualcreditreport.com and you can actually get a free report every 4 months by getting one from each of the 3 different agencies. Don't wait until you are applying for a loan - just do it regularly to make sure everything is correct.

All you have to do is get in touch with the credit bureau and dispute it. If they cannot provide evidence within 30 days, it will be removed from your report. I disputed an incorrect credit limit amount, they had to remove the entire line in my report. I went through a bankruptcy 2 years ago & have tons of information on credit reporting, whats legal and not....look into the Fair Credit Reporting Act at FTC . gov. Also, never ever ever get one of the credit reports that claim to be free except for the one mentioned by Lou above, they are not from FICO and are not accurate. It is a good idea to purchace your reports every 6 months from http://www.myfico.com/12/Home.asp That is the ONLY place to get the real deal, and you get your score as well as the 12 negative factors.

Is there truth to the rumor that everytime someone checks your credit, your score goes down?? My dh gets LIVID when I want to check it, or I give someone permission to check it, and in our case, the stupid Collections guy who supposedly checks it once a week. He gets mad because he believes, or has been told that everytime someone looks at it, you lose a few points. Ours is horrible anyway, not sure there is much we can to repair it at this point, but its just the principal.

I'm no expert but I think the deal is the score goes down if your credit is checked becaused you applied for credit. Companies check your credit all the time - like whenever you get those credit card apps in the mail but your credit score is affected if you apply for lots of different credit.

If you ask for credit, each inquiry can lower your score by up to 12 points!!! There are situations that can lower it even if you don't apply for credit, if they have "cause" to check your report. Like a collector.

Now saying that, if you apply for a mortgage or car loan, you can apply as many times as you want in a 14 day period, they will count only as 1 inquiry.

I've always read that the only inquiries to your credit that might LOWER your score are applications for new credit. So an individual can check their own credit with no problem, creditors can check to see if you qualify for something with no deterimental affect etc
