Backstory:

About a year ago I signed up to do an at-home, study at your own pace program. I have found that I really do not like the material or the setup. I did not have any of the material in that first three day cancellation window to know how much I'd like it.

I am paying on a loan for ten modules that I received. Collateral for the loan is said modules. I called the company yesterday and got a woman who was being deliberately obtuse. She was a big PITA. She kept asking me how I know I didn't like the setup or presentation of the material if I hadn't looked at ALL the modules. UMM, b/c they are layed out the same way?

Anyways, my question is, would the company be required to refund the money if I sent them back all the unopened material I have? Or is there any way possible for me to get out of this loan w/out defaulting on it?

TIA

I don't know much about this one, so I hope someone has a better answer. But it appears that the company themselves are extending the credit to you. I would return the modules, requiring a receipt by the shipper (through the mail, as you know, you can require a signature), with a letter of explanation and ask for a refund. If they refuse, you can go to the Better Business Bureau and any other place they are affiliated with. You may end up simply suing them in small claims court to get your money back. In other words, it will be difficult, and it will be dependent on them wanting to keep their name clean. Keep a copy of all correspondence.

As far as the "loan" which is probably not really a loan, they may put a black mark on your credit if you refuse to pay it. In your shoes, I would cut my loss, and pay no more. Then, I would monitor my credit report, and if they put a blemish on it, I would first ask the agency to remove it, providing backup, and if they refuse, they MUST put your comment of explanation on the report.

You're probably going to be out something. I'd just chalk it up to a learning experience. But I'd also do some googling and see if others feel as you do and include your own comments.

Why did you wait a whole year to try to get your money back? It seems like that would work against you, KWIM?

Was there a guarantee that you would like the program or you would get your money back?

Call your states attorney general's office. They should be able to answer your question for you.

Good luck!

Not sure I understand what kind of loan it is. Is it an educational loan, mortgage, private line of credit? Did you enroll in a class and now want to get out of it? I agree with the Attorney Generals office may be able to help you. Also, the Consumer Protection Agency if you haven't extended past the statue of limitations already.

It's been a year b/c I've had alot of things happen in my personal life in the last year. And I was trying to make it work.

It's basically a line of credit jointly extended through a bank and the program.

Thanks for the heads up on the attorney general's office.
