Default I have to go to court.

I hope ya'll won't be too harsh on here because I feel terrible already. I'm relunctant to even post this but here it goes. I got served papers to go to court next month because of a credit card we owe a little over $1000 on. I called the law office that day to settle this but they said I had to pay the whole thing or go to court. We agreed that I would pay $200 monthly to be taken automatically out of our checking. I thought then I wouldn't have to go to court but then when I asked the lady if I still had to go she laughed and said I can't tell you what to do. We are so strapped for cash as it is. I don't work because we have one car and someone will have to send the boys to school in the mornings. I'm thinking about part time work but we live in a very small town and jobs are limited. My dh says I should go to court and maybe they would settle on a smaller amount and put a freeze on all the interest charges. I've never been to court and to be honest I am terrified.

Believe me, court is not that bad!!! Unfortunately, I have been way too many times. (Not for financial reasons) They are usually willing to work with you and want to settle things.

I don't know anything about going to court for not paying your CC so I can't give any advice on that one. I just wanted to say I'm sorry that you have to go through all that stress. Hope things work out o.k for you .

I've never heard of going to court for not paying a credit card bill either. I used to work in a collection agency and we would make credit arrangements with people or settle with them. If they just did not pay, it basically just gave them a bad credit history.

I'm sorry you are going through such a difficult time.

Oh you poor thing! I can only imagine how scared you must be feeling. I don't know if this will make you feel any better, but I wanted to tell you that we learned a little bit about this in our Financial Peace University classes. It really isn't a scary thing, from what Dave Ramsey said. You have made an agreement with the cc company to pay $200 a month, right? As long as you have made payments in a consistent manner, the judge will just uphold the decision that you and the cc company has made. If there were other problems or issues, that might affect the decision, but I really would try not to worry about it. Yes, I know, that's easy for me to say, but I really think that things will work out fine here. They probably are just doing it to either scare you into making one lump payment or want to make sure that you'll make your payments.

And please don't ever feel hesitate to post something about your finances here. These ladies on Mommysavers are REALLY supportive. Trust me - I've been through a lot of stuff financially that was really rough, and I got so much support here. We're here for each other!! You can count on us.

Keep us posted on what happens at court. I'll be thinking of you!!

Well when I was 18 I opened ever cc out there.. I did have to go to court for 1.. When I was 22.. It is not that bad! They will either have you make a settlement, pay back plan [sounds like you already did] or agree on dropping price owed it paid in full. Make sure you recieve letter saying it has been paid in FULL. When you are done. You will need it later in like. Buying a house or car. I know pain in Butt! Don't worry about it to much. They will have a moderator there to help you and loan dept. person discuss it out..

I just don't know if I should call the collection office again and try to reason with them so I don't have to go or is it just mandatory once the date is set. The date is set for July 25 and a sherriff gave me the papers. He acted real nice but I know the neighbors were talking. It scared me because I thought something bad had happened to my dh at work. I was shocked to be served papers on a cc which to me is a small amt. to be going to court over. It was a $500 cc but we had it hard a couple of months and missed a few payments. It went way up since the finance charge was 29 percent interest and we had late fees plus overdrawn fees. Believe me I've learned my lesson with credit cards. So now we owe $1110. I got the credit card when I was working at a daycare and then it shut down. My dh works production pay and it varies from week to week. I'm so stressed over bills as it is and I'm at my wit's end. My dh called the court house and talked to someone and she said it would be in my best interest to still show up even tho we had payment arrangements made with them. She asked about me getting a lawyer but we can't afford one and for such a small amount to is silly. I say small but it feels like alot when you don't have it. She said even tho we made payment arrangements if we didn't show up they could withdraw even more from our banking to get this paid. I don't understand alot of this. I want to pay this and put it all behind me.

A few years back I was served with papers from court from a collection agency for a medical bill that was a measley $145. I couldn't believe that they were taking me to court.
Anyway, I called the collection agency and made arrangements to pay this bill in installments. She sent me out the paperwork confirming our arrangement and I was so naive that I thought it was done and over with. I was trying to fix the problem before it went to court. Well she went to court and I didn't. It appears on my credit report as satisfied but it has haunted me for the past 7 years. It is almost time for it to drop off my credit report thank goodness.
I think that even though you have made arrangements that you need to 1. get it in writing from the company. 2. Go to court so that they can see that you are willing to work things out.
Also like someone else said that once you pay it off make sure that you get it in writing and save all correspondence.

I work as a legal assistant at the credit bureau.(9 months now)Anyways,we sue people for owed bills that they refuse to pay...When they go to court,they are charged an interest charge from the date of service and attorney/court cost.It ends up being around 500.00/600.00 more usually.But you can then make arrangements to pay the creditor in installments or they would garnish.Not saying it's like that where you are but here it is.It's not a scary thing i promise.Just get it over with and it's done.BUT I would suggest calling the collection agency and ask what you could do to avoid court.If they say only payment in full,then take your chances and go to court.That way at least you will get to pay off the debt in payments.Good luck and message me if you have anymore questions.ok??
