I want to slap someone right now. 2 months ago we re-mortgaged. We built our house and just prior to the house being finsihed the bank we were using decided it was not going to give us any more funding. We ended up pulling off credit cards, getting lines of credit all to get the house finished. Once the house was finished we ended up getting a second mortgage. Our first mortgage came due 2 months ago and we ended up using a Credit Union. They paid out both mortgages and we finally have some breathing room in the debt department. Unfortunatley when they paid out the second mortgage the mortgage company took out a mortgage payment at the same time. I called them and they said they had no record of the mortgage being paid out. The lawyer called them they said they solved everything and would be sending me a cheque for the payment they took out. It's been 2 months and no cheque. I called the company today and they claim they have no record of the mortgage being paid out!!!! (Luckily I place a stop payment on all cheques to them) I called the lawyer and the office is closed for the next two weeks for holidays. Why do I think I am never going to see that money again.

I'd love to call another lawyer but this lawyer has the proof that the mortgage was paid (copy of bank draft, courier slip and person who signed for cheque at mortgage company) Guess I'll just have to cool my heels until my lawyer is back.

that sucks... this kind of stuff chaps my behind keep on top of it. it's not only about the money it's the principle that they are taking money that does not belong to them.

It appears that you (your lawyer) has physical proof that this transaction occurred. What somehow didn't happen is a record (entry) getting on the computer in your account statement history. You should be fine in the end; you just have to wait two weeks. Keep the faith and hang on.

I have worked in the financial/mortgage industry for a long time. Someone or some general ledger is out of balance! Tell them to check their records.
