This may sound horrible- but I have a serious question. When I first became a SAHM- things were extremely tight and DH barely made enough to keep our heads above water for just our basics (yet too much for assistance). There was a few credit cards that we could not keep up with (they were not willing to help out- I tried at the time). So anyways earlier this month DH got a letter from court to appear against a claim from a credit card company. The statutes of limitations is only 4 years in our state. Anyways- DH appeared in court for the hearing and the lawyers for the cc was a no show- judgement was in DH's favor. The judge told DH that cc companies do this all the time and it ends up costing them a lot of money and that the cc lawyers have 30 days to appeal the case (fingers crossed- almost 30 days God willing). Anyways- if the cc lawyers do not try to appeal- are we still responsible for paying off the debt? Also- if you can use SOL as a defense- do you not have to pay back the amount owed and you have to wait the 7 years to clear it off your credit report. I am also having issues with finding the paperwork to completely back up the SOL case (we are missing two bank statements from that year- I have to relook through the paper mess)- is there a way that you can get the exact last date of activity besides requesting a credit report (last time we checked our credit report it did not have any dates on it)?

TIA! I hope this does not make me sound like a horrible dead beat- but the amount they are asking for is ridiculous ($3500 for when the last cc statement I have was for $475!) and I refuse to pay them that much money (especially considering the credit card companies wrote it off and a collection agency got it for pennies on the dollar! If that is the case they truly work!).

Here is a great link for raising your fico score. It's a forum that everyone shares their experinces with working on their own credit issues. FICO Forums - FICO Forums

Sounds like you are working hard to put this financial stress behind you and I would love for this to help you have a great spring board back to great financial health.

All my best to you and your family for a wonderful holiday.

p.s. another great place for all legal info is Nolo: Law Books, Legal Forms and Legal Software
