Default Never thought it would come to this... HELP!!!

Okay.. so basically it comes down to our house is in foreclosure. I sent paperwork to our mortgage agency hoping to do a payment arrangement plan but just found out that we were declined for that. Our income was not high enough... so, I'm figuring based on what the reason for their denial that, to begin with, our original mortgage agency put us in a mortgage we couldn't afford (obviously, we're going into default). Has anyone else been here?!? What did you do?!? Is there anyone I can contact to get us out of this... our sale date is 2 weeks away... I'm so scared...... I don't know what to do.. I have 3 little ones at home and we're about to lose our house... HELP!!!!

I know nothing about foreclosure, but if you get it paid before the two wks can you still keep the house? Do you have any family willing to loan you the money? Of course that would still mean you would have to find a means of increasing your income or decreasing your bills or you wouldn't be able to keep up with it still. Hope you can find some way to work it out.

Well, I called a couple of those online stop foreclosure agencies.. What rip-offs. One said they would need us to file chapter 13 bankruptcy (which I figured) but that they would need $1400 - but they would lower that to $1000 - how nice of them. The other said they would need $2500 to do something... So, I called a local bankruptcy attorney, he said he charges court costs ($334 in my area) and that would be all... so. Thanks for your prayers. I'm sure God's going to get sick of hearing from me... LOL... But, in a sense, all I (we) can do is offer it up to Him and let Him lead us where He wants us to go... Just wish I knew His plan.

I don't know much about foreclosure either, but I remember Suze Orman talking about it on her show a few weeks ago. I looked up the information on her website, and it sounds like there are some other options for you to consider:

Yes unfourtunatly that is what they do. on our First house they approvec us up to three times what we knew we could do.

Can you do a Pre forclosure sale??

Maybe that'd be better than forclosure??
Because even if you stop it and file for chapter 13 - You May end up here again if you can't afford it.
Plus You'd be paying all kinds of late fees and Court costs

Have you turned towards your church for Resources? I would start there.


ALso out the phone book -see if there are any other lawyers who can stop it , or any other resources.
Someone has to be able to help point you in the right direction at least. There has to be options.

I have experienced pre forclosure yrs ago -
But we were working on it months before the actual sale date .... so I don't know if you have the same otions this late.

It sounds like you are wanting to keep the house? I would think very seriously about whether or not you can keep up with it, even if you temporarily stop the foreclosure. Will you be in the same boat 3 months from now? If the mortgage was too big for you, I would say it would be too big no matter what you do or how you look at it. Maybe you are better off letting the house go. However, it all depends on how much other debt you have.

I was just wondering how far do you have to be behind before they foreclose? and do they give you a warning before they do?
My friend had to file for bankruptcy so they wouldnt foreclose on her house. My thoughts and prayers are with you

We were 3 months behind (literally, 3rd month hit and bam!). The mortgage company really didn't give us any notice.. had I not called them I probably wouldn't have known until we got a letter from an attorney like 5 days later and then a notice of Sheriff Sale a few days after that. We are consulting with an attorney to see if it's best to file Chapter 13 or just let it go. I've been told that after the sale it can take up to 9 months (sometimes longer since the foreclosure rate in my area is so high) to have to be out.. so we'll see, pray and keep a positive outlook that something will go right!
