I feel sorry for this woman and her family but I think she had a crummy lawyer. The right of an insurance co to recover money they had to pay due to the fault of another person (in this case the trucking co who caused the accident) is standard policy on almost any insurance policy. If I went and looked at the fine print of my health insurance policy, it would most likely have an identical clause to that effect. This lady's attorney should have known and negotiated a settlement/sued for enough damages to cover having to reimburse the insurance compay and leave this woman enough money to live on with her disability. I noticed that "legal fees" took a huge chunk of her damages award:
Two years after the accident, Shank and her husband, Jim, were awarded about $1 million in a lawsuit against the trucking company involved in the crash. After legal fees were paid, $417,000 was placed in a trust to pay for Debbie Shank's long-term care
Hmmm, $1,000,000 -417, 000 = $583,000 That's a lot of "fees." IMO, their attorney has a lot more to be ashamed of than Walmart.
I worked for Walmart several years ago in the same state as this woman. I quit about four years before her accident, but at the time Walmart no longer managed their own health plan. Employees were covered under a policy through Blue Cross Blue Shield. Unless in those four years the company went back to self managing their health plan (which I doubt), there is likely another party involved here- the insurance company.
This woman would have been in the same boat even if she had been insured through a policy from a more popular retailer/corporation. Except maybe CNN wouldn't be running another article about how evil Walmart is.
