Seller didnt send item, now what???

I bought one of those toy organizer things on ebay at the begining of Feb and have yet to receive it. I have sent several emails asking where the item is and havent gotten response so I opened a Pay Pal claim and nothing. I am out almost $40! I get online today and see that this women has 4 negs in the past few days b/c of items not being delivered and she didnt respond to emails and pay pal claims. So my question is....what do I do now? Do I wait and see if she responds to my pay pal claim? Also, will I ever be able to get my money back or am I out the nearly $40 w/ nothing to show for it?

I am not positive on this but I believe you can file a claim with Ebay. Hopefully someone with more knowledge can fill you in a little more.

I hate so say this but you are most likely out your 40 bucks. But on the bright side those toy organizers arent all that great. I hated mine.

If you paid with Paypal then you most likely will get your money back. That is the advantage to using Paypal. I know I did when something like that happened to me. Plus something may have happened to the seller ie. death or illness in the family. Did they have good feedback prior to the 4 negative. Also their computer could have crashed. Sorry I am always looking for the good in people. Try to think positive you will have a longer life span. You could also call Paypal and ask what ever questions you have and speak to a real person.

They did have some negs prior to my buying but they were from a long time ago and had only had pos since then.

I did file a claim w/ pay pal so I guess I will just have to wait and see what happens. Hopefully I can get my money back.

Did you pay with your paypal account or with a credit card through paypal?

You can dispute the charge on your credit card.

I paid w/ my pay pal account. Part of it was existing funds and the other part came out of my bank account.

This just happened to me and I got my money back via Paypal yesterday. The seller didn't respond to Paypal's emails so the claim was automatically decided in my favor. I had pretty much written it off as a loss so was pleasantly suprised that Paypal was able to get my money back. Don't give up hope on Paypal's claim resolution service quite yet........

Have you filed with Ebay's Item Not Received process? There is a time limit, so you might want to do this now. A month is plenty of time for the seller to get the organizer to you.

Also, make sure to send your emails through Ebay's messaging feature, so you'll have a record with them of your attempts to contact the seller. If you just send them from your email program, they may not accept them as proof of attempts. And, have you gotten the seller's contact info from Ebay and tried calling them? It's an extreme measure, but it might light a fire under them.

Filing with Paypal is also good to do. You may not get your money back right away, though. I've never been through this, but from what I've heard, if the seller's account is empty, there's nothing for Paypal to refund to you. If more money is added to the account later, Paypal may use that for refunds, but I'm not sure how long they keep things open.
