Default Memories Photography - Beware

A month ago I had my daughter’s picture taken at Memories Photography in a Mall about an hour away. It was one of those places that dress the kids up in old clothes and take antiqued pictures. We made our selection and paid for them. I paid extra to have them shipped to me so I didn’t have to travel back to the mall to pick them up. They were suppose to be shipped 11/22. I never received them. I start calling the number on my receipt and keep getting voice mail. I left message after message then finally got a mailbox full message when I called. So, I call the mall to try and get another phone number for this place…the guy skipped town with everyone’s money and pictures. These were to go out with our Christmas cards. I am furious. The manager at the mall said I could file a police report but that they had no idea where he was or how to find him.

These pictures were very prices and so cute. How do these people sleep at night?

That is frustrating... especially if the pictures were already taken (and it sounds like they were) - developing film & making prints (digital or film) is the cheap part of being a photographer. It almost doesn't even make sense.

I'm so sorry that happened to you. Along with the police report, I'd call the BBB. How about contacting a local TV station and having them do a story?

If you paid with a credit card you may have recourse through your card company. That is why when I pay with my debit card, if I am given a choice between debit and credit I always choose credit. If you choose debit you have no recourse at all.

Actually, if you use a debit card, I don't know about legally, but your bank may indeed assist you with a dispute. I'm with BofA and have disputed charges. They have investigated and credited my account. It's worth a try. Of course, you can't abuse this, because they do track it for fraud and excessiveness, and you have to have a good reason. I'd say this is one of them. The problem is, that after 60 days, you're SOL.

By the way, have you talked to the mall about this? It would seem that they would require a bond or something before letting someone have a booth in their mall, just for cases like this - I would think they would carry some liability if they didn't protect their customers. In addition, it seems they would have tracking info, too!

I'm sorry this happened to you. I hope you can get this guy or people who did this. It sounds like the pictures would have been cute. I don't know why people can be so hateful.
